Use the service. Pay your invoices. Don’t do crime.

These Terms govern your use of Backyard Bandwidth services. They’re written plainly because we don’t have time for interpretive dance in court.

Agreement

By accessing, using, or continuing to use Backyard Bandwidth’s services, you affirm that you have read, understood, and agree to be legally bound by these Terms and the Fair Use Policy. If you do not agree, you must stop using the services immediately.

“But I didn’t read it” = you still agreed to it.

1. Compliance with United States Laws

By using Backyard Bandwidth services, you affirm, represent, and warrant that you will comply with all applicable United States federal, state, and local laws and regulations while accessing or using our services. Backyard Bandwidth operates under U.S. jurisdiction. Violations of U.S. law while using our services may result in immediate termination without refund and potential legal action.

You also agree you will not use the service if you are:
  • Located in a country or region subject to U.S. trade restrictions, sanctions, or embargoes, including but not limited to:
    • China
    • Iran
    • Russia
    • North Korea
    • Any other jurisdiction restricted under U.S. law
  • On any U.S. government denied persons or restricted entity list (including OFAC SDN or BIS Entity List).
  • Engaging in activity that violates U.S. export controls, financial regulations, or other legal restrictions.

Backyard Bandwidth reserves the right to restrict or terminate services for any user or entity it reasonably believes is in violation of this section. Users are responsible for ensuring their use does not violate U.S. laws or compliance obligations.

Governing law

This section is governed by United States federal law. Disputes under this clause shall be resolved in a court of competent jurisdiction within the United States.

2. Service and Refund Discretion Policy

Backyard Bandwidth reserves the sole and absolute right to refuse service to any individual, entity, or jurisdiction at its discretion, without obligation to provide justification. This includes cases where a customer is suspected of violating policies, engaging in prohibited activity, or posing financial/reputational risk.

Refunds are not guaranteed.

Refunds are assessed case-by-case at our sole discretion. We may deny any refund request for any reason, including:

  • Failure to comply with Terms, Fair Use, or other agreements.
  • Termination due to non-payment, policy violations, or legal/regulatory concerns.
  • Requests based on dissatisfaction unrelated to service functionality/performance.
  • Substantial use of the service period/resources.
  • Failure to cancel before the next billing cycle.
No chargebacks or disputes.

By using our services, you agree not to initiate chargebacks, payment disputes, or unauthorized reversals. If you do, we may terminate your account immediately and pursue recovery of costs incurred.

We may modify this policy at any time, effective upon posting. Continued use = acceptance.

3. Billing and Account Termination Policy

Customers must ensure timely and full payment for all services. Invoices unpaid for more than 7 days past the due date may be considered delinquent. We may terminate services for accounts past due beyond this period at our sole discretion.

Termination consequences
  • Immediate termination: delinquent accounts may be terminated without further notice.
  • Permanent data deletion: terminated accounts and associated data may be permanently deleted without recovery.
  • No liability for data loss: we are not liable for data loss due to non-payment termination.
  • Collections / legal: unpaid balances may be referred to collections or legal proceedings; you are responsible for associated fees/costs.
Customer responsibility
  • Maintain accurate billing information and valid payment methods.
  • Authorize charges for recurring services, applicable taxes, and outstanding balances.
  • Failed payments may result in fees or service disruption.
No refunds

Unless explicitly stated in a separate written agreement, payments are final and non-refundable. Termination due to non-payment or policy violations does not entitle you to a refund or credit.

Collection efforts

We may send reminders and attempt reasonable collection. Unpaid balances may be referred to third-party collections or legal action. You agree to pay associated costs (attorney fees, court fees, collection fees, etc.).

4. Price Modeling and Changes

Backyard Bandwidth may modify pricing at any time to reflect operational costs, market conditions, inflation, or business needs. Price changes may apply to new and existing customers unless otherwise specified.

Notice and acceptance

For price increases, we may provide advance notice via email. It is your responsibility to keep your contact information current. Continued use after the effective date constitutes acceptance. If you don’t agree, cancel before the change takes effect.

We are not obligated to issue refunds/credits due to pricing changes unless required by law or a written agreement. Disputes shall be governed by U.S. law and adjudicated in a court of competent jurisdiction within our state of operation.

5. Fair Use Agreement

You agree to comply with U.S. laws and our Fair Use rules. Illegal, malicious, or unauthorized activities are prohibited and may result in immediate suspension/termination without refund.

Prohibited activities include (not exhaustive):
  • Hosting/distributing illegal content (including child exploitation, controlled substances, etc.).
  • Hacking, phishing, fraud, or compromising systems/networks/data.
  • DDoS attacks, botnets, or network abuse.
  • Spam or unsolicited bulk messaging.
  • IP infringement (trademarks, copyrights, patents).
  • Bypassing security measures or unauthorized access attempts.
Enforcement + logging reality

We enforce terms to the extent technically and legally possible, consistent with our No Logs Policy. We do not do “active surveillance” beyond what’s operationally required (abuse mitigation, stability, billing, etc.).

If a violation is detected within our capabilities, we may take appropriate action, including reporting to law enforcement and immediate termination. You acknowledge violations may result in termination without refund and that we are not liable for damages arising from enforcement.

6. Cooperation with Law Enforcement

We respect user privacy and operate under a strict no-logging stance. We will comply with legally binding requests only when required by law and within the technical/physical limitations of our infrastructure.

What might exist (minimal retention):
  • Limited account information: half-email (or hashed email where applicable), if available.
  • Temporary IP logs: IP address stored temporarily for up to 24 hours for anti-abuse/security, then deleted.
What we do not store:
  • Browsing history or traffic content logs.
  • VPN session durations/timestamps/connection metadata history.
  • User-assigned or original IP addresses beyond the temporary window.
  • Content/files/messages transmitted through services.

If a valid request is made, we may evaluate validity, respond only as required by law, and notify the affected user unless prohibited. We may challenge requests we deem unlawful, overly broad, or rights-violating. See No Logs Policy.

7. Support Charges

Customers receive limited free support: maximum of three (3) support inquiries per month. Additional support may be charged at our discretion.

One-time Support Charges (after free limit)
  • Basic: $5 per additional issue (simple setups, minor troubleshooting, general questions)
  • Advanced: $25 per additional issue (config assistance, network debugging, setup)
  • Critical: $50 per additional issue (complex debugging, major problems, priority response)
Monthly Support Plans
  • Basic Monthly: $10/mo (3 → 6 tickets)
  • Advanced Monthly: $20/mo (3 → 8 tickets)
  • Pro Monthly: $30/mo (3 → 10 tickets)
  • Unlimited Monthly: $200/mo (no limit)
Support rule:

“It broke” is not a support request. Provide the service, what you did, and the exact error. Facts > feelings.

8. Changes to These Terms

Backyard Bandwidth may modify, update, or amend these Terms and related policies at any time. Changes are effective immediately upon posting unless otherwise stated. Continued use constitutes acceptance. If you do not agree with updated terms, discontinue use.

We may provide additional notice for significant changes, but we are not required to for enforcement.
